Important Information

This Warranty is given by Apollo Batteries (SA) Pty Ltd ACN 008 173 340 trading as Independent Battery Distributors (IBD) of 94 Research Road, Pooraka SA 5095 Telephone: (08) 8260 6111 Email: ibd1@senet.com.au

 

IBD warrants in favor of the original purchaser of this battery (Purchaser) that the battery will be free of defects for the period from the date of purchase specified on the top label of the battery (Warranty Period).

 

If within the Warranty Period a defect is discovered in the battery then IBD will, at IBD’s option, repair or replace the battery at its cost or refund the purchase price paid by the Purchaser.  If the battery is repaired or replaced under this Warranty, the repaired or replacement battery will be covered by this Warranty for the remainder of the Warranty Period.

 

This Warranty does not apply to fair wear and tear.  This Warranty will not apply if any serial number on the battery is removed or if the battery is:

altered or modified prior to or after installation;
installed or maintained by any person other than a qualified trades person;
charged otherwise than in accordance with the manufacturer’s specifications (including under or over charging);
stored, handled, operated or maintained in any way contrary to the manufacturer’s specifications or otherwise improperly stored, handled, operated or maintained;
exposed to any abnormal climate conditions or operating circumstances;
subjected to misuse, neglect, negligence, accidental damage, or act of God; or
used after any defect in the battery becomes apparent or would have become apparent to a reasonably prudent operator or user.

 

In order to make a claim under the Warranty, the Purchaser must return the battery to the place of purchase together with proof of purchase.  IBD will examine the returned battery and if it determines that the battery is defective and that the Purchaser is entitled to claim under this Warranty, it will repair or replace the battery or refund the purchase price in accordance with this Warranty.

 

If the battery is found to be working or if the Purchaser is not entitled to claim under this Warranty in respect of the battery, the Purchaser must pay all reasonable costs of testing the battery before the battery will be redelivered to the Purchaser.  IBD’s determination of the existence of any defect in the battery or whether the Warranty covers the Purchaser’s claim is conclusive.

 

The Purchaser will be responsible for all costs of returning the battery to IBD (including de‑installation and re-installation) and for collection or redelivery of the battery (whether original or repaired and/or replacement battery) by IBD and any other expenses of the Purchaser in claiming under this Warranty.

IBD will not be responsible for:

any loss or damage to the battery occurring while the battery is in transit (either on return to IBD or upon redelivery to the Purchaser of the original or repaired and/or replacement battery);
any loss or damage caused by any delay in assessing the Purchaser’s claim or in repairing or replacing the battery.

 

The benefits of this Warranty are in addition to any other rights and remedies available to the Purchaser under the law.

 

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.  You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.  You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
